1.Scope of Service and Platform Functions

AiStyle is an AI-powered personal styling, digital closet, and outfit recommendation engine. The Platform executes specific automated workflows based on user input and authenticated third-party data integrations, including but not limited to:

• Onboarding & Style Analysis: processing facial and body image attributes (face, skin, and body photographs) for styling analysis only — never for identity verification or biometric identification — using Artificial Intelligence and Large Language Models (LLMs) to generate seasonal color, face type, and body shape reports.
• Digital Closet Management: providing image processing and enhancement for uploaded clothing items to maintain a virtual catalog.
• Smart Calendar Scheduling: synchronizing data from third-party schedule APIs to perform automated weather, location, and situational event analysis for dynamic outfit suggestions.
• Virtual Try-On & E-Commerce: allowing interactive cosmetic, clothing, and accessory visualization overlays alongside purchase linking with partner retail brands.

1.1 Acceptable Use

Access to and use of the Platform itself is limited to personal purposes. You may not resell, operate the Platform on behalf of others, or make it available as a service to any third party. Usage rights for images generated through the Platform, including for commercial purposes, are governed separately by Section 5. You agree not to:

• Use the Platform for any unlawful or prohibited purpose.
• Reverse engineer, decompile, or disassemble the Platform or any of its underlying models or software.
• Interfere with, disrupt, or attempt to circumvent the Platform's functionality or security.

1.2 Availability of the Service

We do not guarantee that the Platform will be uninterrupted, error-free, or continuously available. We may perform maintenance, updates, or changes to the Platform at any time, including without prior notice, and we are not liable for any resulting downtime or loss of access.

2.Account Registration and Third-Party Integrations

To access the core analytical features of the Platform, you must create a secure profile. We offer account creation and identity verification through the Google Login API. When utilizing this integration, you agree to grant us authorization to retrieve your verified email address, profile name, and system unique identifier.

We adhere to Google's principle of requesting the minimum relevant permissions. We only request access to the necessary scopes (profile, email, openid) required for user authentication and to personalize the user experience within the AiStyle platform. We do not request access to information that is not essential for our application's features or services. Where you additionally connect a calendar account, we request only the scopes needed to read the events used for outfit planning.

You acknowledge that you are entirely responsible for safeguarding your credentials and maintaining account security. You agree to immediately notify us of any unauthorized use or security breach concerning your profile.

3.User-Generated Content and Image Upload Policy

Our platform relies heavily on user-generated data to provide personalization. For details on how we collect, use, and protect this data, see our Privacy Policy. When uploading imagery via our Photo Upload Service, you explicitly declare and warrant that:

• You possess full legal rights, ownership, or explicit license to the uploaded photographs (including portraits of yourself and your clothing assets).
• The content does not infringe upon any intellectual property rights, copyrights, publicity rights, or privacy rights of any third party.
• The content strictly complies with global safety standards and is completely free of unlawful, explicit, offensive, hateful, or harassing visual elements.

3.1 Third-Party Likeness

You may only upload portraits of yourself. You may not upload photographs of any other person, whether or not you have that person's permission, and you may not use Virtual Try-On, outfit rendering, or any other image-generation feature to depict a person other than yourself.

• No Face-Swap or Identity Manipulation of Others: you may not use the Platform to swap, transplant, blend, or otherwise apply any other person's face, body, or likeness onto imagery, including celebrities, public figures, or people you know, regardless of consent and regardless of whether the resulting image is labeled as AI-generated.
• No Deepfakes or Non-Consensual Intimate Content: you may not use the Platform to create sexually explicit, intimate, or degrading content depicting any real person, or content intended to deceive, defame, harass, or impersonate another individual.
• No Minors: you may not upload photographs of, or generate images depicting, anyone under the age of 18.

3.2 License You Grant Us

You retain ownership of your uploaded content. You grant AiStyle a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit to our service providers, and display your uploaded images solely for the purpose of operating the Platform and delivering the features you request. This license terminates when you delete the content or your account, subject to Section 7.

We do not use your photographs to train AI models, and our AI service providers are contractually prohibited from using content submitted through our paid API integrations to train their models.

3.3 Moderation

We reserve the right to monitor, filter, or immediately delete any user-generated asset processed by our Image Processing Service that violates these guidelines, without prior notice or liability.

3.4 Reporting Misuse of Your Likeness

If you believe your likeness has been uploaded to or generated on the Platform without your consent, contact us at support@theaistyle.com with a description of the content and where it appears. We will review reports promptly, remove content that violates Section 3.1, and may suspend or terminate the responsible account.

4.Artificial Intelligence and LLM Processing Disclaimer

Third-party AI providers may update, modify, or discontinue their models or APIs at any time; we do not guarantee that any specific model will remain available.

To deliver these features, your uploaded images and profile attributes are transmitted to the third-party processors named above. Their processing is governed by our agreements with them and by our Privacy Policy.

5.AI-Generated Images and Your Responsibility

AiStyle uses AI to generate images (such as styled portraits, virtual try-on visualizations, and outfit renderings) from the photos you upload. By generating, downloading, or sharing these images, you agree that:

• Usage rights: to the extent permitted by applicable law, AiStyle does not claim ownership of images generated for you through the Service. You may use such images for personal and commercial purposes in accordance with these Terms.
• Nature of generated images: they are AI approximations for stylistic and recreational purposes, and may not accurately reflect your real appearance or any real-world scene.
• AI labeling: AiStyle adds a visible "AI Generated by AiStyle" label when you download or export an image. Certain images may additionally carry an invisible watermark applied by the underlying model provider. You may not remove, hide, or falsify any such label or watermark, or claim the image is an unedited photograph. Our labeling methods may change as we adapt to AI transparency requirements in the jurisdictions where we operate.
• Your responsibility after download: once downloaded or shared, you are solely responsible for how you use the image, including posting it on social media or anywhere else.
• Compliance with law: you are responsible for ensuring that your use and sharing of a Generated Image complies with applicable law in your jurisdiction (including publicity and likeness rights, defamation, and any AI-generated content disclosure or labeling laws) and with the terms of any third-party platform on which you share it.
• Prohibited uses: you may not use generated images to impersonate, deceive, defame, or harass anyone, or to create non-consensual or sexually explicit content.
• No liability: AiStyle is not liable for how you use, share, or misuse a generated image after download.

6.Commercial Transactions, Subscriptions, and Credits

Premium features, long-term digital closet storage extensions, and deep analytical reports require an active commercial subscription, credit balance, or one-time purchase. All payment processing workflows are securely offloaded to our payment processor, Airwallex. AiStyle never saves, logs, or directly handles raw credit card numbers or billing credentials on our Data Stores.

6.1 Credits

Certain AI features consume prepaid credits. Credits represent a limited license to use Platform features. They are not currency, have no cash value, and are non-refundable and non-transferable except where required by applicable law. Credits do not expire while your account remains active. We may change the credit cost of any feature at any time; changes apply to future usage only. If a paid AI operation fails to produce a result, the credits reserved for that operation are returned to your balance automatically.

6.2 Digital Content and Immediate Access

By purchasing digital content or digital services, you expressly request immediate performance and acknowledge that you lose your statutory right of withdrawal once performance has begun, to the extent permitted by applicable law. This does not affect your right to a refund where the Service is defective, was not delivered, or where a refund is otherwise required by applicable law.

7.Suspension, Termination, and Data Deletion

We reserve the right to suspend or terminate your account and Platform access if you breach these Terms, misuse API interfaces, reverse-engineer proprietary recommendation logic, or manipulate the platform architecture in a manner that degrades service performance for other users. We will provide reasonable prior notice where practicable, except where the breach is severe, unlawful, or poses a risk to other users or to the Platform, in which case suspension may be immediate. Unused credits are forfeited upon termination for breach.

You may close your account at any time from your account settings. Upon deletion, we remove your uploaded photographs and Generated Images from our storage within thirty (30) days, except where retention is required by law or necessary to resolve a pending dispute.

8.Eligibility

You must be at least 18 years old to use the Platform. If you are under 18, you may not create an account or upload any photograph. We do not knowingly collect images or personal data from minors, and we will delete any such account upon becoming aware of it.

9.Disclaimer of Warranties and Limitation of Liability

The Platform is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

To the maximum extent permitted by law, AiStyle's total aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total amount you paid to AiStyle in the twelve (12) months preceding the event giving rise to the claim, or (b) EUR 100. AiStyle shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or goodwill.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where you are a consumer in the European Union, your mandatory rights under the Digital Content and Digital Services Directive (EU) 2019/770 or equivalent local law to have non-conforming digital content or services brought into conformity, to a proportionate price reduction, or to terminate the contract.

Indemnification: you agree to indemnify and hold AiStyle harmless from any claims, liabilities, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Platform.

10.Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email at least seven (7) days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not accept them, you must stop using the Platform and may close your account.

11.Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-law rules.

If you are using the Platform as a consumer, this Section does not deprive you of the protection of any mandatory rules of the law of your country of habitual residence, and does not affect your right, where you reside in the EU/EEA, to bring proceedings relating to these Terms or the Platform before the courts of your own country of residence instead of the courts referred to below. AiStyle may only bring proceedings against you as a consumer before the courts of the country in which you are domiciled.

Subject to the foregoing, any dispute arising out of or relating to these Terms or the Platform shall be submitted to the Harju County Court (Harju Maakohus) as the court of first instance.

12.Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary and the remaining provisions shall remain in full force. Our failure to enforce any right or provision does not constitute a waiver of it. You may not assign or transfer these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AiStyle regarding the Platform. These Terms may be made available in multiple languages; in the event of any conflict, the English version controls.
